2023 Published Fee Schedule
Fiduciary Fees are attached upon commencement of fiduciary services irrespective of when formal, legal, or Court documents are received or executed. The COVID era has created extraordinary delays with Courts, professionals, and financial institutions in processing legal documents and Court Orders.
Hourly rates for Fiduciary Services range from $175 to $400 depending upon the skill level, the complexity of the case, and the experience of the licensed Private Fiduciary. Hourly rate is established upon acceptance by the Private Fiduciary and is subject to annual review and hourly rate increase.
Services provided include but are not limited to:
*Minimum time charge for meetings, phone calls, travel time, receipt and reply to emails, faxes sent and received, receipt and review of correspondence, letter and memorandum writing, preparation of accountings, scanning and archiving hard copy documents and correspondence, and other ancillary duties is 6 minutes. The above is not a comprehensive list of possible fiduciary tasks. Before 9 a.m. and after 4:00 p.m. on weekdays and any time on Saturdays, Sundays, and State and Federal holidays, time is billed at time and a half.
Fiduciary Services for a Decedent’s Estate, Trust Administration and/or Probate:
Trust Administration: 1.25% of the gross value of the estate per year, subject to a $5,500 minimum fee. Fee is subject to modification if administration requires extraordinary services and if the value of total hours worked exceeds the 1.25% value of the gross value of the estate, wherein the Trustee fees will be calculated by the total number of hours worked times of the case hourly rate stated above. Trustee fees are payable 50% four months after the commencement of the trust administration, and the balance is payable upon termination of the administration or upon annual anniversary whichever comes first. Expenses are billed at cost.
Often, a licensed private fiduciary with TAD Executive Fiduciary Services is appointed on Estate Planning documents without prior notice. When a death or disability occurs, the fiduciary is responsible for marshaling the assets and handling the administration, which includes but is not limited to paying the debts of the decedent and making distributions. As a policy of TAD Executive Fiduciary Services and at the sole discretion of the successor Trustee, at the time of distribution of the estate, the Trustee will retain a reserve for at least 18 months to cover any unascertained or unknown liabilities of the decedent, including Federal, State and local taxes. TAD Executive Fiduciary Services, at the sole discretion of the successor Trustee, will petition the relevant Superior Court for approval of the Trust/Estate accounting and distribution to beneficiaries with an appropriate reserve. Upon approval by the Court, the estate balance will be distributed to the beneficiaries as per the Court Order.
Probate/Executor: Statutory Fee as per Probate Code
*Minimum time charge for phone calls, emails, faxes, receipts, and review of correspondence is 6 minutes.
TAD Executive Fiduciary Services will provide, as per the legal documents or statutory requirements, quarterly or annual accountings for services provided on an hourly basis, unless the fee structure is based on a percentage. TAD Executive Fiduciary Services will maintain books and records in accordance with reasonable bookkeeping records and practices.
